1. Agreement to Terms

By accessing and using PopaSite ("the Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Description of Service

PopaSite provides website creation and hosting services for businesses. Our service includes:

• Pre-built website templates tailored to your business
• Website hosting and maintenance
• Custom domain setup (optional)
• Email hosting (optional)
• Basic content management system
• WhatsApp Business API integration for customer messaging
• Customer support

3. User Accounts and Registration

To use our service, you must:

• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Be responsible for all activities under your account
• Notify us immediately of any unauthorized use

4. Payment Terms

4.1 Subscription Fees

Our service is provided on a subscription basis:

• Monthly subscription: $89 NZD per month
• Annual subscription: $890 NZD per year (2 months free)

Both plans include everything: professional website, custom domain registration, hosting, SSL certificate, SEO optimization, and customer support. Your domain is included at no extra cost and registered in your name.

4.2 Payment Processing

Payments are processed securely through Stripe. By subscribing, you authorize us to charge your payment method for the subscription fees.

4.3 Billing and Cancellation

You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period, and you keep access until then.

4.4 30-Day Money-Back Guarantee

If you are not happy with your website, email us within 30 days of your first payment and we will refund that payment in full — no questions asked. This applies to your first subscription payment on both monthly and annual plans.

4.5 Your Domain Is Yours

Any domain we register on your behalf belongs to you. If you cancel, we will transfer the domain to you at no charge on request. We do not hold your domain, website content, or data hostage.

5. Acceptable Use

You agree not to use our service for:

• Illegal activities or content that violates laws
• Spam, phishing, or other malicious activities
• Content that infringes on intellectual property rights
• Adult content, violence, or hate speech
• Activities that could harm our systems or other users
• Violating Meta's Platform Policy or WhatsApp Business API terms
• Sending unsolicited messages via WhatsApp without proper consent

6. Intellectual Property

6.1 Your Content

You retain ownership of all content you upload to your website. By using our service, you grant us a license to host, display, and distribute your content as necessary to provide the service.

6.2 Our Service

PopaSite and its original content, features, and functionality are owned by us and are protected by international copyright, trademark, and other intellectual property laws.

7. Service Availability

We strive to maintain high service availability but do not guarantee uninterrupted service. We may perform maintenance, updates, or modifications that temporarily affect service availability.

8. Limitation of Liability

To the maximum extent permitted by New Zealand law:

• Our service is provided "as is" without warranties
• We are not liable for indirect, incidental, or consequential damages
• Our total liability is limited to the amount you paid for the service
• We are not responsible for third-party content or services

9. Indemnification

You agree to indemnify and hold harmless PopaSite from any claims, damages, or expenses arising from your use of the service or violation of these terms.

10. Termination

We may terminate or suspend your account immediately, without prior notice, for:

• Violation of these terms
• Non-payment of fees
• Fraudulent or illegal activity
• At our sole discretion

Upon termination, your right to use the service ceases immediately.

11. Third-Party Services and Meta Integration

Our service integrates with third-party platforms, including Meta's WhatsApp Business API. By using our service:

• You agree to comply with Meta's Platform Policy and WhatsApp Business API terms
• You understand that Meta may process your data according to their privacy policies
• You consent to the sharing of your phone number and message content with Meta
• You acknowledge that Meta's terms and policies apply to WhatsApp messaging services
• You agree not to use WhatsApp messaging for spam or unsolicited communications

12. Governing Law

These terms are governed by the laws of New Zealand. Any disputes will be subject to the exclusive jurisdiction of the New Zealand courts.

13. Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of significant changes via email or through our service. Continued use of the service after changes constitutes acceptance of the new terms.
